Necessary Blackness Ep: 81 – Justice For Elijah Nichols

Necessary Blackness Podcast sat down with Aunt of Elijah Nichols, Kindra Nichols for an exclusive one on one interview. This is the first time the family has spoken out about the injustice faced by their loved one. Elijah Nichols promising career as a football star was derailed after he had to defend himself at a white frat party against 3 aggressors. The 18-year old was attending college and was a proud father to a newborn baby before being handed a 45 year sentence.

The sentencing of Elijah Nichols is a tragedy and reeks with racist implication from Judge Joey Showwalter, who sentenced Dustin Lee Moore, who attended the same school, to 2 months for killing a student during a hazing. However, Elijah will have to serve a 45 year suspended sentence for defending himself against 3 white students at a frat party. Mr. Showwalter seems to always use his discretion coupled with leniency when the defendant is White but, impose the maximum amount of sentence to Black defendants. When a freshman was busted on campus for selling marijuana, ecstasy and cocaine, Mr. Showwalter used the mercy of the court despite the defendant being found with $25,000 in cash and a 9mm gun which was found during a search of his on-campus apartment.

Judge Joey Showalter is known for holding fundraisers and speaking on behalf go local and state Republican candidate and is a staunch support of President Donald Trump. Many believe the sentencing of Elijah to 45 years is symbolic to Trump being the 45th President of the United States.

Family Sues After 7-Year-Old Gets Handcuffed At School For Crying

What is taking place in the educational system in America is symbolic to the wrenching condition and racist views of society. For as far back as we can remember, education was used as a weapon of oppression to subjugate Blacks. The racial educational barriers erected by systemic racism, is alive and well today in 2016. So, it does not surprise me to read about a 7-year old being handcuffed at school for merely crying.

Kaylb Wiley Primm, a second grader attends a public school in Kansas City. He is only 7 years old, less than 4 feet tall and weighs less than 50 pounds, but the police officer considered him a threat to his and others safety.

 

The incident began when a school-based police officer happened to walk by Kaylb’s classroom and hear him crying and disrupting other students, according to a lawsuit filed last week by the American Civil Liberties Union on behalf of Kaylb’s family. When Kaylb continued to cry and yell in the hallway, against the officer’s requests, the officer put the child in handcuffs and brought him to the main office, where he sat until a parent arrived.

There is a growing movement of concern parents who are opting out of sending their children to the public school system and are deciding to home school. NYCLU Demands That NYPD Stop Handcuffing 5-Year-Olds

The New York Civil Liberties Union (NYCLU) is demanding sweeping changes to current discipline guidelines for the more than 5,000 school safety officers in New York City. The NYCLU has previously sued the NYPD for use of force against students and wrongful arrest, made the demands during a press conference Wednesday, stating that school discipline should be handles by educators, not the police.

Parents Outraged: Student Punished For Helping Hungry Friend

All the 13 year-old Kyle Bradford did was share his chicken burrito with his friend didn’t want to eat the cheese sandwich the cafeteria was serving.
